What is regulated by this program?

All demolitions and all renovation activities that will disturb friable asbestos containing material greater than or equal to 160 square feet, 260 linear feet, or 35 cubic feet. This is determined by an Asbestos Hazard Emergency Response Act (AHERA) certified inspector prior to disturbance. Demolitions of facilities without asbestos are also regulated.

Facilities regulated by this program:

Public, commercial, industrial buildings, and apartment complexes of greater than 4 units.
Two or more residential houses.

Facilities NOT regulated by this program:

One private residence.
Apartment complexes of 4 units or less.

GENERAL GUIDELINES FOR RENOVATION & DEMOLITION PROJECTS

  1. Determine if the building has been inspected by an AHERA-certified asbestos building inspector during the past year. If it has been, obtain a copy of the asbestos report to determine if asbestos is present. If it has not been inspected, have the building inspected by an AHERA-certified asbestos inspector and verify his or her certification. Obtain a copy of the inspection report and determine if asbestos is present. It is recommended that the asbestos inspection report be available on site throughout the entire demolition/ renovation project.
  1. Determine the amount of friable asbestos containing material. If the amount is 160 square feet, 260 linear feet, 35 cubic feet or more, it is regulated asbestos and must be removed by a certified contractor prior to any disturbance activity.
  1. Strongly consider hiring a third party consultant who has asbestos contractor/ supervisor training to oversee the project. If you do hire a consultant, pay attention to the recommendations and guidance. 

FOR RENOVATION PROJECTS

  1. Prepare or review the proper 10-day notification form and be aware or the duration of the project. If the renovation requires the removal of regulated asbestos as defined above, the notification form must be postmarked or hand delivered to Maricopa County Environmental Services Department at least 10 working days prior to the commencement of the renovation project, with the notification fee.

FOR DEMOLITION PROJECTS

  1. Prepare and submit the 10-day notification form with the notification fee. This notification must be postmarked or hand-delivered to Maricopa County Environmental Services Department, NESHAP Coordinator, 1001 N. Central Ave., #300, Phoenix, Arizona 85004 at least 10 working days prior to the commencement of demolition activities.

  2. Notification forms can be downloaded from our we site at www.maricopa.goc/envsvc/air/asbestos.asp or can be obtained from our office.

  3. Make sure that you obtain all required permits for your project (i.e., Earthmoving/ Demolition Permits from Maricopa County Environmental Services Department).

  4. Remember: you as the owner/ operator, are responsible for all phases of asbestos removal, transportation and disposal.

Notification fee

There is a nonrefundable notification and plan review filling fee of $425.00. A separate fee is required for renovation and demolition.

EXAMPLE:  a commercial building being abated and then demolished will require a fee for abatement and a fee for demolition.

AHERA – Asbestos Hazard Emergency Response Act.

Asbestos – the asbestiform varieties of serpentinite (chrysotile), riebeckite (crocidolite), cummingtonite-grunerite, anthophyllite, and actinolite-tremolite.

Category I (CAT I) nonfriable asbestos containing material (ACM) – Asbestos containing packings, gaskets, resilient foor covering, and asphalt roofing products containing more than 1 % asbestos as determined using the method specified in appendix A, subpart F, 40 CFR part 763, section 1, Polarized Light Microscopy.

Category II (CAT II) nonfriable ACM – Any material, excluding Category I nonfriable ACM, containing more than 1% asbestos as determined using the methods specified in appendix A, subpart F, 40 CFR part 763, section 1, Polarized Light Microsopy that, when dry, cannot be crumbled, pulverized, or reduced to powder by hand pressure.

Demolition -  The wrecking or taking out of any load supporting structural member of a facility together with any related handling operations or the intentional burning of any facility.

Friable – Any material that, when dry can be crumbled, pulverized, or reduced to powder by hand pressure.

NESHAPs – National emission Standards for Hazardous Air Pollutants pursuant to 40 CFR part 61, subpart M (1990).

Regulated asbestos-containing material (RACM) – (a) Friable asbestos material, (b) Category I nonfriable ACM that has become friable, (c) Category I nonfriable ACM that will or has been subjected to sanding, grinding, cutting, or abrading, or  (d) Category II nonfriable ACM that has a high probability of becoming or has become crumbled, pulverized, or reduced to  powder by the forces expected to act on the material in the course of demolition or renovation operations regulated by this subpart.

Renovation – Altering a facility or one or more facility components in any way, including the stripping or removal or regulated asbestos containing material (RACM) from a facility component. Operations in which load supporting structural members are wrecked or taken out are demolitions.
